WWE Attorney Jerry McDevitt On How He Would Describe Vince McMahon, WWE Network Royalties and Lawsuits, WWF Being Rebranded WWE

Jerry McDevitt, the lead attorney for WWE, appeared on The Two Man Power Trip of Wrestling podcast for a 70-minute interview about his life and career. From originally working for WWE in 1987 as part Jim “The Anvil” Neidhart’s case against US Airways through the steroid trials of the 1990s and all of the current day issues regarding concussions and WWE Network royalties, McDevitt addresses these topics in great detail. Highlights from the interview, which you can listen to here, are as follows.

The WWE Network royalties lawsuit being dismissed:

I think (Rene) Dupree was being manipulated by the same lawyer that has been running around bringing these CTE cases against the company and in fact we know he is. That whole business started with this guy advertising on the internet looking for people to sue the WWE and that he’s made various promises and representations to these people about what he thinks he is going to get for them and all the rest of that. After the judge in the CTE cases issued her subsequent rulings throwing out two of the cases and five-sixths of the other one while expressing skepticism about whether that claim would survive, shortly after that we believe he got Dupree to bring this royalties case as kind of a way to deflect attention from what was happening in the other cases and knowing full well that frankly Dupree’s case couldn’t go anywhere. As matters turned out (Dupree) evidently didn’t tell the lawyers he recruited to bring the case and to hide his own involvement that he had signed not one but two contracts that prohibited him from bringing such claims and as soon as the lawsuit was brought to my attention I sent an email the night they filed it to the lawyer in Chicago.

I brought this to the attention of the Chicago lawyer and said I assume you don’t know this because any lawyer who saw these documents wouldn’t bring this lawsuit but here is what your client signed. And as you can see it absolutely prohibits this lawsuit that you’ve brought and that I demand you withdraw it immediately. And he wrote back saying very professionally thank you and that I was not aware of this and that he’ll look into it. And I am sure he did and as the evidence shows, he then withdrew the lawsuit which was the only proper thing he could have done frankly. He could have not continued the lawsuit at all once. I brought that to his attention and Dupree would have known it too, and it was all designed I think to create some negative publicity for the company and see if they could maybe get somebody better then Dupree to bring such a lawsuit which is kind of “trolling” if you will for a plaintiff.

How does the dismissed case differ from the Doug Somers/Gilbert Family lawsuits:

I don’t think it does. They were trying to make it different by making contractual claims but these claims have never succeeded yet and I don’t think they ever will. Gilbert, Somers and there are a bunch of cases like Freddie Dryer and a bunch of guys that opted out of the NFL and if you remember the NFL had similar cases. They had a class action case brought against them from former NFL players on the NFL Network which the NFL as they seem to do, have a lot of money to throw around and they chose to settle with that class and pay them some money. But a couple guys, including Freddie Dryer, and the rest of about twelve others opted out of that class and brought their own lawsuit alleging that the NFL owed them more money then I guess was bigger than they would have got through the class action settlement (which was kind of a dumb move). Now you have to survive motions to dismiss that can be filled to dismiss such claims and the NFL did and they lost and the court threw their claims out.

Basically, the way the law works on this stuff is pretty simple. We are the owner of the copyrights of all of these things. The WWE is the sole and exclusive owner of the copyrights. Federal copyright law rewards the people who make the investments in creating these copyrighted works and go out and hire the talent and the stadiums and the cameras and all the expense of creating these films with exclusive rights of display, reproduction and sale. So when these people come in and say you are being unjustly and I’m not getting any of this money, the defense is always that the federal copyright law gives us the exclusive right to do it and preempts any of these state law claims that you are trying to assert that would burden our rights of ownership and they get thrown out every time.

Why he feels talent from defunct promotions have no claim to royalties from the WWE Network:

Let me use ECW as an example. ECW if you recall your history went into Chapter 7 bankruptcy. Whenever you go into a Chapter 7 bankruptcy what happens is your assets and your liabilities are marshalled. The bankruptcy trustee tries to sell the assets of the bankruptcy estate to generate some cash to pay off creditors who would be for example any ECW talent that are owed money from ECW and would share any money that is available which is usually not very much because when you are bankrupt you don’t get very much and when somebody goes bankrupt like ECW does it essentially wipes out all the claims of anybody that they would have against ECW for contract royalties or contract claims against ECW. The assets of the company are put up for sale free and clear of all liens and that is part of the whole bankruptcy sale. When you think about it nobody is going to buy assets that carry with it liabilities. So what you had there was this entire film library of ECW that would have been sitting somewhere in a cardboard box right now and not being displayed anywhere, and the WWE decided it would buy and pay money to buy the films and the copyrights that go with those films and obtain from the bankruptcy court a bill of sale giving the WWE in exchange for the money we paid for those the sole right, title and interest to the copyrights of those works. That is why the WWE has the legal right to display them on the Network free and clear of any claims, plain and simple.

Is Vince McMahon preserving the history of professional wrestling?

Yes and I think you can see it by his actions. He is a custodian of wrestling history right now and it’s been his whole life. It’s been the life of his family, it’s generational. I think he cares greatly about the history of this business and has great respect for the people who have been part of it and who have helped him build it.

How would he describe Vince McMahon?

I think he is a fascinating person. One of my favorite stories about Vince is when you first undertake to represent anybody as a lawyer you form judgments about the people you are representing and whether you get emotionally invested in them or whether you don’t. Are they honest? Are they truthful? In the early days when I was forming my relationship with him back in the early 90s and during the time the government was doing all this and it was a horrible time because all of the tabloid wars and all of these horrible and sensational stories telling these lurid and false tales about people up there; it was just miserable times. What I will always remember was one day when the headlines were just terrible and lurid and false and the kind of stuff that would make everyone angry, we were walking out of his office late at night one night and there was this fella, a janitor named Nick, who I learned later that he had a need for a dialysis machine in the building in order to keep his job which they did just to keep this janitor working.

When I came out of the office I saw him standing there mopping the floor and Vince came out of the office right after me and was walking down the hallway and Vince turned around after this hellish day and goes back and starts asking how’s his family, how are you doing and took the time to care about that little guy in the building that most people probably wouldn’t know his name. But he did and he cared about him and that was such an interesting scene. And I have never forgotten that about Vince. A part from that, part of him as a business man he is fascinating to watch and I think he is a great marketer of our era and what he has done with this business is just mind boggling when you watch WrestleMania and you see the production values and the people from all over the world that come to see it, it’s extraordinary. When you see the influence on television even beyond wrestling and you see how these politicians now use sort of the ring entrance mode to build drama for themselves in various ways and how the NFL has stolen, if you will some of the camera techniques that were used in the XFL, his influence on television and marketing is extraordinary.

Billy Jack Haynes being the “lead” wrestler to sue WWE as part of the ongoing concussion lawsuits:

Billy Jack Haynes goes all the way back to the late 80s/early 90s and he was doing the same stuff then and everybody in the business knows what he is. The idea that this “trolling” campaign where this Kyros fella was out there looking for people to sue and the best you could come up with was a Billy Jack Haynes to supposedly put forward as he’s going to be the representative of a class representing all of the people to ever perform for the WWE? Do you really think for a minute that people like Rock and Stone Cold think that Billy Jack Haynes is somebody they want representing their interests? It’s ridiculous. That is basically what he would be doing in that situation.

He (Kyros) was doing the same thing with him (Billy Jack Haynes) but just trying to do it with Dupree and that was trying to make some very sensational charges that were false from the minute they were made. When they were made, we got on the phone with him and said these charges you have made are false and you know they are false and if they are not withdrawn, we are going to seek sanctions against you. They quickly withdrew much of what they said that was absolutely false. They have continued to do the same thing however and the recent opinion that the judge issued dismissing Haynes’ claim and dismissing the claims of (Russ) McCullough, (Ryan) Sakoda and Matt Wiese (Luther Reigns) is (the judge) actually made findings that they had made false allegations in the lawsuit and noted that there are sanctions and notions pending against them and went on to describe all of these totally inconsistent and sometime incomprehensible allegations through this litigation. Billy Jack Haynes is just being used and will never see one penny for anything.

The rebranding of the World Wrestling Federation to World Wrestling Entertainment in 2002:

Actually it was kind of interesting the way that transition took place pretty quickly. It was another one of Vince’s clever and genius ideas to just switch one letter. The whole ordeal with the World Wild Life Fund was kind of crazy, and I never did understand why they cared because nobody ever confused us with them and watching the whole English Court proceedings and seeing how different that was then American Court proceedings was kind of frustrating from my standpoint because it was the one big case that I couldn’t handle. The English Court would not allow American Lawyers to try cases in their court rooms and so I could only go there and watch. And it was infuriating to sit there and watch that and to not be able to do anything. But whenever they issued their orders that we couldn’t be “WWF” in the way we wanted to be anymore, it was just too burdensome to comply with the requirements of what we had to do if we were going to be “WWF” and so Vince just came up with the idea of we will change to “WWE.” And I don’t know if you remember the slogan “get the F out;” It’s kind of clever and now it actually captures what they do maybe better than the word federation anyway because they are an entertainment company and that is exactly what the business is so it was a very successful rebrand I thought.

Jim Ross Gives His WWE Payback Predictions

If you’re planning on betting on WWE Payback on Sunday, you might want to check out Jim Ross’ predictions for the event. The WWE Hall of Famer updated his blog on Friday with his predictions for Payback 2016.

Ross predicted the main event first, saying he thinks while AJ’s first WWE PPV main event will be impressive, Roman Reigns will get the win to retain the World Heavyweight Title. He thinks the co-main event between Charlotte and Natalya will also result in the champion retaining, as he predicts Charlotte will “squeak out a quality win” over Nattie.

Despite Ross wanting to see Cesaro win the IC Title, he thinks The Miz will cheat to win in their match on Sunday. He says Ambrose will go over Jericho in “what should be a really good wrestling match.” Ross thinks losing to Lesnar at WrestleMania gave Dean’s TV persona a boost.

The former WWE Head of Talent Relations predicts Sami Zayn will be victorious over Kevin Owens in a bout he says he’s excited to watch live. Ross thinks Ryback will cheat the smaller underdog Kalisto out of the United Stats title, and says he likes Ryback as a bully heel, but suggests he learns to “occasionally retreat.”

Report: TNA Owed Bobby Roode & Eric Young A Combined Six-Figures

David Herro, founder of Great Lakes Championship Wrestling, says he knows the real reason Bobby Roode and Eric Young left TNA. “Bobby Roode and Eric Young left because they were owed a combined six-figures,” Herro said on the Pro Wrestling Report.

“How do you not pay those two guys?” Herro asked. “You let Bobby Roode go… a guy who could have gone to WWE but he wanted to be loyal to the company. Thank God he left. He’ll be a big star in NXT. He’ll make the main roster in a year from now. Same with Eric Young.”

As far as TNA’s future goes, Herro thinks they need a management change. “I wish Ring Of Honor would buy TNA,” Herro said of TNA’s current financial problems. “They already have the infrastructure in place. They already have the TV deal alone. They’re already in more markets than Pop TV.”

Herro also pointed out that TNA does not currently get paid by Pop TV, and that they bartered for their Impact Wrestling time slot.

Finn Balor To Debut On Main Roster At WWE Payback?

According to inside sources, former-NXT champion Finn Balor is expected to make his WWE main roster debut at WWE Payback Sunday.

After Balor dropped the NXT Heavyweight championship at NXT Lowell to Samoa Joe, it was only a matter of time before Balor would make the jump to the main roster. These sources also correctly told us of Joe’s win before it even happened.

He is expected to debut, while Luke Gallows and Karl Anderson attack AJ Styles, causing him to beat Reigns by disqualification. As of this writing, there is no confirmation as to which side Balor will lean towards.

WWE Payback is emanating from Chicago, Illinois, which is a crowd to root against Reigns with all their might. Balor’s main roster debut has also been anticipated for over a year now.

This Week’s SmackDown Viewership Decreases

The April 28, 2016 edition of WWE SmackDown averaged 2,109,000 viewers on the USA Network. This is down from last week’s 2,431,000 viewers. SmackDown was ranked #7 on the Top 150 cable shows for the night.

SmackDown went up against John Cena’s new American Grit series on FOX in the 9 PM ET time slot. American Grit averaged 2,190,000 viewers on Thursday.

The NFL Draft was the evening’s viewership leader with 6,289,000 viewers on ESPN.

Announcer Kyle Edwards (Arda Ocal) is no longer with WWE. He had been with the company since September 2014.

Paul Heyman Lands New Reality Series

Paul Heyman and his Looking4Larry advertising/marketing  agency will be the focus of a new unscripted series currently in development.

Heyman is partnering with Left/Right Productions on the show, an NYC-based production company specializing in television and film projects that “illuminate the drama and comedy of real life.” According to their website, Left/Right tells “stories that are both honest and surprising, revealing and entertaining, dramatic and cinematic.”

In an interview with The Wrap, Heyman said the show is completely unscripted and shows all of the problems his company is forced to solve on a daily basis. The article mentions that Heyman’s “ingeniously dysfunctional” approach to his job will be well-documented in the series.

“It’s the juggling act,” Heyman said. “I’m a single parent looking to demonstrate to his children that you can work your ass off and have the time of your life doing it. I sleep two hours a night, so if I don’t keep busy, I end up getting myself in a lot of trouble.

“At least now if I get in trouble, it’ll make for good television.”

The pilot episode is currently being filmed in New York City. No word yet on the distribution model for the show, whether it be traditional television or an online streaming service, but The Wrap reports that Lionsgate and British TV networks are interested in the show.

WWE Network Adds Chyna Collection To Streaming Service

The WWE Network is paying tribute to the late Joan “Chyna” Laurer. The streaming service added a collection of Chyna’s greatest moments and matches with WWE on Friday. Chyna passed away on April 20th from what her manager says was an accidental overdose of prescribed medication. Here’s what you’ll find in the WWE Network’s “Chyna Collection” so far:

WWE Considering DVD’s For Rick Rude, Kurt Angle, Undercard Wrestlers & More

WWE issued a new Fan Council Survey this week to gauge interest on potential DVD and Blu-ray titles for 2017. Courtesy of Wrestling DVD Network, here are the DVD titles WWE is considering:

Bayley Injury Scare, Daughter Of WWE Hall Of Famer Debuts In NXT & More

– Prior to Thursday night’s NXT TV tapings, Manny Andrade defeated Angelo Dawkins. The former La Sombra won with the running knees in the corner and was said to be very over with the crowd. 

– Rachael Ellering, daughter of WWE Hall of Famer Paul Ellering, made her NXT debut at this week’s tapings. She’ll will face Alexa Bliss on the May 11th episode. Ellering was trained by Lance Storm.

– Bayley appeared to tweak her knee on Thursday night while reversing a suplex from Nia Jax. She was able to finish the match, but was helped to the back after being checked out by a trainer. It’s entirely possible that this was simply an angle – we’ll post an update if there’s anything to the story.

Lucha Underground Star Coming To PROGRESS Next Month, Tag Title Match Announced For Chapter 30

PROGRESS have announced that Matt Cross AKA Lucha Underground’s Son of Havoc will be making his company debut at the Super Strong Style 16 tournament at the end of May, the updated lineup for the SSS16 tournament is now:

Eric Young Explains Why He Joined WWE NXT (Video)

Former TNA Champion Eric Young made a surprise debut for WWE NXT at Thursday night’s TV tapings from Full Sail University.

After departing TNA Wrestling last month, Young made an impact by picking a fight with the biggest dog in the yard, newly crowned NXT Champion Samoa Joe.  Minutes after his first NXT match, EY spoke with Cathy Kelley about his decision to jump ship to the hottest pro wrestling promotion today.

Ric Flair’s Podcast On Hiatus Over Money Issue

Shortly after Ric Flair was treated for a cut on his head at Logan Airport, his Woo! Nation podcast co-host revealed that the podcast is on hiatus because Flair “terminated the contract.” His co-host, Conrad Thompson, said the airport incident had nothing to do with the podcast going on hiatus.

Thompson wrote that Flair is doing “fine,” and the issues with the podcast are over money and not his health. Thompson says he does think the podcast will be back, but doesn’t know when.

Flair’s podcast started back in May of 2015 when he interviewed Kurt Angle. The podcast has been inactive since WrestleMania weekend when the 46th installment was recorded in Dallas.

– NXT Champion Samoa Joe was in the ring to open up the show, when Eric Young made his debut by coming out to challenge Joe to a match. Joe accepts and says he’ll destroy him.

Mark Henry Talks About Chyna’s Passing, Possible WWE HOF Induction

The World’s Strongest Man Mark Henry was a guest on this week’s Cheap Heat podcast and spoke about the tragic passing of Joanie Laurer (Chyna). It’s another great episode that is definitely worth checking out. Henry’s segment starts 2 minutes into the show.

The first time he met Chyna was at the gym. She had her back turned and he didn’t know who she was. Triple H walked over and said, “I want you to meet Joanie.” He didn’t realize the person with her back to him was Joanie. He said she was the largest woman he’d ever met.

Henry remembers Chyna having a great sense of humor. They got along great from the beginning because they both loved lifting weights. He would try all the time to get her to break character and laugh during WWE TV segments. The only time he remembers her cracking up was the time she mooned the crowd with DX.

Chyna had incredible presence and was stronger than a lot of the men. Some male wrestlers didn’t want to work with her and would say mean things about her appearance, which he said Chyna was hurt by.

Henry always expected Chyna to come back to WWE, but everybody has their demons. When asked his prediction of whether or not Chyna will be inducted into the WWE Hall of Fame one day, Henry said:

“That’s a hard question. My opinion is my opinion. Does she deserve it? Yes. That will be my answer.

Main Event Announced For Next NXT Takeover

It was revealed at Thursday’s NXT TV tapings that Samoa Joe will be defending his NXT Title in the main event of the next NXT Takeover special. His opponent will be former champion Finn Balor. Joe beat Balor for the NXT Championship at a live event last week.

The next Takeover special will take place on June 8th at Full Sail University in Winter Park, FL and will air on the WWE Network.

The title match between Joe and Balor is the only match announced for the card as of this writing.

Lucha Underground Viewership Drops This Week

The April 27th episode of Lucha Underground averaged 107,000 viewers on the El Ray Network in the first run, and 52,000 viewers for the replay for a total of 159,000. This is down from last week’s total of 198,000 viewers, with 149,000 people watching the first run and 49,000 watching the replay.

The show didn’t place on the Top 150 cable shows for the night. This is the fifth week in a row they haven’t placed on the chart.

The show’s highest viewership ever came earlier this month on April 4th with a total of 234,000 viewers.

Eric Young Debuts In NXT (Video)

Former TNA World Champion Eric Young made his NXT debut at tonight’s tapings from  Full Sail University in Orlando, Florida. Young confronted NXT Champion Samoa Joe in the opening segment of the evening. We’ll update this post when new details become available.

Both Young and Bobby Roode left TNA Wrestling departed TNA Wrestling earlier this month after over a decade with the company. Roode made a surprise appearance at NXT Takeover: Dallas and was shown ringside watching the action.

Back on April 9th, the Peterborough Examiner published an interview with Roode, who stated that he was not yet signed with WWE. At the time, and this was over 3 weeks ago, Roode said, “I’m not officially signed yet. The Internet has blown up over it, and I mean I’m close, but I don’t want to spoil anything or ruin anything. I want to wait until it’s official. I don’t want to jinx anything either.”

WWE is reportedly interested in bringing both men in as “player coaches,” which would see them working NXT events as well as training up and coming talent at the WWE Performance Center.

Dolph Ziggler’s Brother Wanted For Murder Of Marine Corps Veteran

Dolph Ziggler’s younger brother Donald Nemeth was charged with aggravated murder. Police obtained a warrant for the 29-year old on Tuesday in connection with the death of 34-year-old Joseph Mascol, who was shot on January 23 at the University Hotel and Suites in Cleveland, OH.

Donald Nemeth allegedly tried robbing Mascol before the shooting. Mascol was found in a seventh-floor hallway, where he was pronounced dead by paramedics.

Nemeth is currently not in custody and anyone who may know his whereabouts are encouraged to call homicide detectives at 216-623-5464.

International betting site 5Dimes.eu updated their odds for Sunday’s WWE Payback pay-per-view. These odds are typically reliable indicators for predicting match outcomes.

  • Roman Reigns is favored (-475) to retain the WWE Championship against AJ Styles (+325)
  • Charlotte is favored (-420) to retain the WWE Women’s Championship against Natalya (+300)
  • Cesaro is a slight favorite (-130) to defeat The Miz (-110) for the Intercontinental Championship
  • Sami Zayn is favored (-145) to defeat Kevin Owens (+105)
  • The Vaudevillains are favored (-400) to defeat Enzo & Big Cass (+280) in the tag team tournament finals
  • Dean Ambrose is strongly favored (-705) to defeat Chris Jericho (+435)

WWE Network Survey Asks If Fans Would Pay Extra For Current Raw & SmackDown

Last night, Andrew “CarlosTheDwarf” Milage tweeted this:

  • This question: “If current episodes of Raw and SmackDown were to be added to WWE Network the day after airing on TV, how much more likely would you be to subscribe to WWE Network?
  • The question “Which of the following are reasons why you would return to WWE Network? (Select as many that apply.)” with this as a new choice: “If there was a premium WWE Network subscription for $12.99 that includes current episodes of Raw and SmackDown the day after they air on TV.

Access to current episodes of Monday Night Raw and SmackDown has often been cited by cord cutters as something that would entice them to subscribe to WWE Network and ditch cable/satellite television subscriptions. WWE’s TV contracts are a hurdle there, and not just domestically. As it is right now, Raw and SmackDown are added to WWE Network 30 days after they air, which is in compliance with all of their TV contracts.

Domestically, the only way to see more than WWE’s YouTube clips online via an officially licensed partner is Hulu Plus. On one hand, it does offer next day Raw and SmackDown. On the other hand, not only is it a separate paid subscription service, but Raw isn’t even complete. USA Network is very protective of the full version of Raw, so they go with one of the edited versions that WWE sends to international television partners. That edit runs about 90 minutes or sowithout commercials, so it would be a “two hour” Raw with commercials. Of course, some fans say it’s a far superior version of Raw, so your mileage may vary.

Last year, WWE ran into a different roadblock with a TV partner when they launched WWE Network in the United Kingdom. At the time, and going back to the early days of the network, Main Event aired live or almost live on Tuesdays. WWE’s deal with Sky Sports, their television partner in the region, conflicted with Main Event airing first on WWE Network, so a change had to be made. From then on, without any announcement or other kind of fanfare, Main Event was taken off the network’s linear feed and wasn’t added to the on demand library until three weeks after it aired everywhere on traditional television.

$3 per subscription doesn’t sound like close to enough to give WWE a war chest big enough to satisfy all TV partners, but they clearly have something in mind.

New Female NXT Announcer, Details On Tonight’s TV Tapings

– TV host Andrea D’Marco recently announced on Twitter that she will be joining NXT. It’s unknown when she’ll first appear on NXT TV, but she says her first day was Monday, so it’s likely she’ll be at tonight’s tapings. D’Marco is a former Miami Dolphins Cheerleader who has previously worked for several South Florida TV channels.

– WWE tapes episodes of NXT TV on Thursday night at Full Sail University in Winter Park, Florida. Stars advertised for the tapings include NXT Champion Samoa Joe, Finn Balor, Shinsuke Nakamura, Asuka, and Austin Aries. Aries will be featured in action on next week’s episode. We’ll have spoilers from the tapings later tonight.

WWE Network Cracking Down On Account Sharing

The WWE Network is cracking down on account sharing with the latest update of its Terms and Conditions. Several readers are already getting error messages about “stream limit exceeded” and “too many usage attempts.”

If a user gets this message, WWE’ support documentation encourages people to log out of the Network on other devices they might be logged in to.

The updated Terms and Conditions reads:

Access to Services:  Access to WWE Network is subject to approval of your Payment Method information and verification of other information you submit to us or that is otherwise provided to us.  Accordingly, if your payment (flat fee or monthly) cannot be processed for any reason, including because your Payment Method is no longer valid, we may terminate your access to the WWE Network immediately. Although your WWE Network subscription is accessible on a number of devices, your use is limited to one (1) WWE Network stream on one (1) device at any given time.  IF YOU CIRCUMVENT OR ATTEMPT TO CIRCUMVENT ANY OF THE USE RESTRICTIONS IN THESE TERMS, YOUR SUBSCRIPTION WILL BE SUBJECT TO IMMEDIATE TERMINATION AND YOU MAY BE SUBJECT TO LEGAL ACTION.  SHARING OF LOGIN INFORMATION, INCLUDING PASSWORDS, IS STRICTLY FORBIDDEN.
