As we previously reported, Matt Hardy had applied to trademark “Broken Matt Hardy” a while back in the midst of his ongoing battle with Impact Wrestling over the rights for the famed gimmick. Per a report from PWInsider, that request was shot down by the U.S. Patent & Trademark Office. If Hardy doesn’t respond to the declination in six months then his application will be dismissed.
Here’s why the U.S. Patent & Trademark Office says they declined the application:
“Registration is refused because the applied-for mark, as used on the specimen of record, identifies only the name of a particular character/personal name; it does not function as a service mark to identify and distinguish applicant’s services from those of others and to indicate the source of applicant’s services.”
